Terms of Service

These Terms of Service (the "Terms") are a binding agreement between you and MationX, a service operated by Petr Kynčl ("MationX", "we", "us"), based in the Czech Republic, Czech business ID (IČO) 29638330. They govern your access to and use of the MationX website (mationx.com), MationX Studio, the MationX Client application, our custom automation services, and any related software, APIs, and services (together, the "Service").

By creating an account, accessing the website, or using any part of the Service, you confirm that you have read and agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

• Service: the website, MationX Studio, the MationX Client, custom development services, and all related tools and infrastructure.
• Studio: the web-based, no-code visual builder used to create and manage automations.
• Client: the MationX application installed on an Android device that executes automations.
• Automation: a workflow you build and run through the Service.
• Snapshot / Selector: captured on-screen UI structure and targeting rules used to build automations.
• Account: the account you register to access the Service.
• Content: the automations, configurations, data, and materials you create, upload, or process.

You must be at least 16 years old (or the age of digital consent in your country) and able to form a binding contract. Business accounts must be operated by someone authorized to act for that business.

You agree to provide accurate information, to keep your account credentials confidential, and to be responsible for all activity that happens under your account. Notify us promptly at [email protected] if you suspect any unauthorized use.

MationX lets you automate Android apps by driving the screen the way a person would. It includes:

• MationX Studio: a no-code visual builder for automations.
• MationX Client: an Android app that runs your automations on real devices as human-like taps, types, and swipes.
• Triggers and integrations: including webhooks and REST-style triggers, notifications, schedules, and integrations such as Google Sheets and AI providers.
• AI features: such as locating elements, performing plain-language actions, and recovering when app layouts change.
• Optional cloud execution and a marketplace where and when made available.

We are continually improving the Service and may add, change, or remove features. We will try to avoid materially reducing core functionality of a paid plan during a billing period.

The Service offers a free Community plan and paid plans (such as Developer Pro and Crystal), plus custom Enterprise arrangements. Paid plans are billed in advance through our payment processor (Stripe) on a recurring monthly or annual basis and renew automatically until you cancel.

• You can cancel at any time; your plan stays active until the end of the current billing period.
• If you cancel during a paid period, we will, on request, refund the unused portion on a pro-rata basis. Time already used, and one-time fees for custom projects once work has begun or been delivered, are non-refundable, except where required by law.
• Fees are exclusive of taxes unless stated; you are responsible for applicable taxes.
• We may change prices with reasonable prior notice; changes apply to the next billing period.

MationX Studio includes an affiliate program. From within your account you can generate a personal referral link and share it to invite new users to MationX. When someone signs up through your link and pays for a subscription plan, you earn a commission on what they pay, as set out below. Taking part in the program means you also accept these affiliate terms.

• Commission: you earn 20% of the subscription fees that a customer you referred actually pays to MationX, for 12 months from that customer's first paid subscription. After those 12 months, no further commission accrues for that customer.
• Eligible referrals: only genuinely new customers who reach MationX through your referral link and who did not already have an account. Referrals are attributed through our tracking; where more than one affiliate could apply, our records are final.
• What is excluded: commission is calculated on the net amounts we actually receive and excludes taxes, refunds, chargebacks, credits, discounts, free trials, unpaid or failed invoices, one-time custom-project fees, and marketplace transactions. If a payment is later refunded, charged back, or otherwise reversed, the related commission is cancelled and may be deducted from your balance.
• No self-referral or abuse: you may not refer yourself, your own or related accounts, or use your link to obtain a discount on your own subscription. Cookie stuffing, spam, fake or incentivized sign-ups, misleading or unauthorized claims about MationX, bidding on MationX brand terms in paid advertising, and any other deceptive or fraudulent promotion are prohibited and void any related commission.
• Lawful promotion: you must promote MationX honestly, comply with all applicable laws (including advertising, marketing, anti-spam, and disclosure rules), and clearly disclose your affiliate relationship where required. You act as an independent party; the program creates no employment, agency, or partnership between you and MationX.
• Payout: commissions are paid in the currency and by the method we make available (for example through our payment processor), subject to any minimum payout threshold and holding period we set, and only for validated, non-reversed payments. You are solely responsible for any taxes due on your earnings.
• Our rights: we may change the commission rate, duration, thresholds, or any other part of the program, and may suspend or discontinue the program, at any time with reasonable notice; changes apply going forward. We may withhold, reverse, or forfeit commissions and remove you from the program without notice for any breach of these Terms, fraud, or abuse. If your account is closed or terminated for breach, any unpaid commissions may be forfeited.

You agree not to use the Service to:

• break the law or infringe anyone's rights, including intellectual property or privacy rights;
• create or distribute malware, spam, fraud, or deceptive or harmful automations;
• violate the terms, policies, or technical protections of third-party apps, platforms, or websites;
• collect, scrape, or process data you have no right to access;
• abuse, overload, or attempt to bypass limits of our infrastructure, or probe or breach its security;
• resell, sublicense, or redistribute the Service or its components except as expressly permitted.

You are solely responsible for the automations you build and run and for their effects. We provide the tooling; the intent, configuration, and execution are yours.

You represent that you have the right and any necessary permission to automate the apps, accounts, devices, and websites your automations interact with, and to process any data involved. You accept the risks of automating third-party platforms, including possible account restrictions, bans, rate limits, or data changes imposed by those platforms.

All software, code, and platforms that make up the Service, including the MationX Engine, the Studio, the Client, the Snapshot and Selector systems, and the MationX name and logos, are and remain the exclusive intellectual property of MationX (Petr Kynčl). Your subscription or payment grants you a limited, non-exclusive, non-transferable license to use the Service, not ownership of the underlying technology.

You keep ownership of your Content. You grant us the limited license needed to host, process, sync, and run your Content solely to provide and improve the Service.

If you would like us to build an automation for you, we can create a custom project directly in MationX Studio for a one-time fee (quoted per project) and deliver it into your MationX account.

• Once delivered, the project is a normal project in your account, governed by these Terms and by the limits and rules of your current plan (Community, Developer Pro, Crystal, or Enterprise), the same as projects you build yourself.
• We retain ownership of the underlying technology and any reusable components; you receive the same license to use it as any other project in your account.
• One-time build fees are payable as set out in your quote and are non-refundable once we have begun or delivered the work, except where required by law.
• Enforcement: if you breach these Terms (for example, unauthorized redistribution, sharing, or unpaid usage), we reserve the right to revoke your license and remotely disable ("kill") the affected automations or account access, without prior notice or refund.

The Service is provided "as is". For custom projects we may provide a limited bug-fix warranty for an initial period agreed in your quote, covering logic errors within our own code.

Third-party changes are excluded. Automations rely on the user interfaces and APIs of third-party apps and websites. Any maintenance or fixes needed because a third party changed its app, redesigned its UI, or altered its API are not covered by any warranty, and such work is charged at our standard hourly rate.

Where a marketplace is available, users may share, buy, or sell projects. Sellers are solely responsible for their listings and for holding the rights to what they publish, and must not offer illegal, infringing, or malicious projects. MationX acts as an intermediary, not the author, may charge a fee or commission on transactions, and may remove any listing that violates these Terms.

The Service integrates with third-party providers (for example Google, WhatsApp, AI providers such as OpenAI, authentication via Google or GitHub, and payments via Stripe). Your use of those integrations is subject to the relevant third party's own terms and policies, and we are not responsible for third-party services or their availability.

We aim for high availability but do not guarantee that the Service will be uninterrupted or error-free, and we may perform maintenance. We may suspend or terminate an account that breaches these Terms, abuses the Service or its resources, or where required by law.

You may stop using the Service and delete your account at any time. On termination, your right to use the Service ends and your data is handled as described in our Privacy Policy.

Some features use AI (for example locating elements, performing plain-language actions, self-healing when layouts change, or drafting automations). AI output can be imperfect or unpredictable. You are responsible for reviewing AI-assisted results and for the outcomes of automations that use them; they are provided without any guarantee of accuracy or fitness for a particular purpose.

To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.

To the maximum extent permitted by law, MationX will not be liable for any indirect, incidental, special, or consequential damages, including loss of data, profits, business, or goodwill, device malfunction, or third-party account restrictions, arising from your use of or inability to use the Service. Our total aggregate liability for any claim is limited to the amounts you paid to us for the Service in the twelve (12) months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

You agree to indemnify and hold MationX harmless from any claims, damages, liabilities, and reasonable costs (including legal fees) arising from your use of the Service, your automations or Content, your violation of these Terms, or your infringement of any third-party or legal rights.

These Terms are governed by the laws of the Czech Republic, without regard to conflict-of-law rules, and the courts of the Czech Republic have jurisdiction over any dispute. This does not deprive you of any mandatory consumer protections available to you under the law of your country of residence.

We may update these Terms from time to time. We will update the "Last updated" date above and, for material changes, provide reasonable notice (for example in the app or by email). Continuing to use the Service after changes take effect means you accept the updated Terms.
